And when this was general for all hunting, he clarified that it is specific to hunting on land. He said: ﴿Lawful for you is the game of the sea﴾; meaning: its hunting; that is, what is primarily based on need. The intended meaning is all bodies of water; from rivers, ponds, and others. ﴿And its food﴾; meaning: its catch; fresh or dried; even if it is floating, cast by the sea; and it is the fish of all kinds; and everything that does not live on land; and what is eaten like it on land.
And when he made that lawful, he mentioned its reason; he said: ﴿A provision for you﴾; meaning: if you are traveling or residing; ﴿and for the traveler﴾; meaning: they take it with them wherever they want from land or sea. In the permissibility of hunting from the sea, in the trial of the blessing upon this nation, what clarifies its virtue over those who were before it, for whom hunting from the sea was a trial on the day of testing. And all praise is due to Allah; and it is apparent that what is meant by the hunting of the sea is the action; because there are two matters: hunting and eating; and the intended meaning is to clarify their ruling. It is as if he made the hunting of sea animals lawful; and made the food of the sea lawful absolutely; whatever they have caught and what they have not caught; whether they are travelers or residents; and that is because when he introduced the prohibition of hunting what is on land by saying: ﴿Do not kill game while you are in the state of ihram﴾ [Al-Ma'idah: 95]; he followed it by clarifying the permissibility of hunting the catch of the sea; in the state of prohibiting that; then he followed it by clarifying the prohibition of the catch of land by saying: ﴿And prohibited to you is the game of the land﴾; meaning: its hunting and eating what is caught from it for you; and it is what has no life except in it; and what lives in it and in the sea; if it is caught for the lawful, it is lawful for the one in ihram to eat it; for it is not attributed to him to hunt it by action; nor by force; ﴿As long as you are in the state of ihram﴾; because the basis of his command is primarily in hunting and eating; from what is hunted for luxury and comfort; and it has also been previously established the prohibition of hunting the catch of land; and the prohibition of eating from what is caught from it; and this has been repeated with the repetition of ihram in the verse: ﴿Except for those who are lawful to hunt﴾ [Al-Ma'idah: 1]; and the verse: ﴿Do not kill game while you are in the state of ihram﴾ [Al-Ma'idah: 95]; so the concept of 'as long as you are in the state of ihram' does not contradict it; and he expressed that to be a text in the prohibition in every part of the time of ihram until the completion of the release from it; and Allah knows best; and the expiation does not fall due to error and ignorance; like the other prohibitions of ihram.
And when hunting is by trapping the catch to where it is unable to escape from it; and the state of ihram is most similar to the state of trapping; in being stripped of sewn garments; and turning away from the world and its enjoyments; he concluded the verse with his saying - in addition to what you intend: "So do not eat anything from it while you are in your state of ihram -: ﴿And fear Allah﴾; meaning: the One to whom belongs all command in that; and in other than it; from hunting; and others; ﴿To whom you will be gathered﴾; so that the presentation to Him is in front of your eyes; and you may be diligent in obeying Him; and cautious of disobeying Him.
