Commentary
And when this extravagance occurs; after these prohibitions; it is a war against the one who forbids it; and sometimes it is by killing; and sometimes by other means; and it may be that he thinks that the punishment for the killer is greater than killing; because he is like one who has killed all the people; and it has reached him - glorified and exalted is He - His saying - in the manner of restriction -: "Indeed, the recompense"; and the original was: their recompense; but it was intended to link the ruling to the description; and to generalize; so He said: "those who wage war against Allah"; meaning: the Greatest King; who has no equal; "and His Messenger"; meaning: by waging war against the one whom they were forbidden to wage war against; by robbing the road; while they are Muslims; and they have protection from whoever intends them; and they target the Muslims in their blood; and their wealth; whether they are in the land; or outside of it.
And when the servants of the Most Merciful walk upon the earth humbly; He made it known that these are the servants of Satan; by His saying: "and they strive in the earth"; and when this is apparent in corruption; He stated it clearly in His saying: "corruption"; meaning: in the state of being corrupt; or for corruption; and it may be that it is a source for "they strive"; in meaning; and when their actions are different; He divided their punishment according to it; so He said: "that they be killed"; meaning: if their crime is only killing; because the punishment for killing is killing; and He added - because it is in robbing the road - that it must be; it is not permissible to pardon it; "or they be crucified"; meaning: along with killing; if they combine with killing the taking of wealth; by raising the crucified on a trunk; and among them are those who said: this would be while he is alive; so then his hands would be extended along with the trunk; and the more correct according to the Shafi'is is that he is killed; and prayers are performed for him; then he is raised on the trunk for a while; his news would spread therein; to deter others; and it should not exceed three days; "or their hands be cut off"; meaning: the right one; by taking their wealth without killing; "and their feet"; meaning: the left one; for frightening the way; and this is the meaning of His saying: "from the opposite side"; meaning: if the crime is only taking wealth; "or they be exiled from the land"; meaning: by frightening; and disturbing; if they do not fall into the grip of the Imam; so that they would be moving from one land to another; in fear and terror; and by imprisonment if they fall into the grip; and they have increased the number of the warring; and they have neither killed nor taken wealth; "that"; meaning: the severe punishment detailed; to what has been mentioned; "for them"; meaning: specific to them; "is disgrace"; meaning: humiliation and shame; by inflicting it upon them; "in this world"; meaning: to deter others by it; "and for them"; meaning: if they do not repent; "in the Hereafter"; meaning: which is the abode of judgment; by manifesting justice; "is a great punishment"; meaning: it is such that it does not fall under your definitions more than describing it as great.
