Commentary
And when this was completed in this strange manner; He clarified - glorified and exalted is He - His secret; and He said: ﴿That﴾; meaning: the matter that is firmly established in this arrangement; by oaths and otherwise; ﴿Closer﴾; meaning: nearer; ﴿To﴾; meaning: until ﴿They come﴾; meaning: those who witnessed first; ﴿With the testimony﴾; meaning: the reality of the matter; ﴿In its essence﴾; without the slightest deviation; because they fear the sin before Allah after this severity; ﴿Or they fear﴾; if fear of Allah does not prevent them; ﴿That it may be rejected﴾; meaning: may be repeated; and returned; ﴿Oaths﴾; meaning: from the heirs; ﴿After their oaths﴾; for finding suspicion; so they become by their exposure a parable for the people; Al-Shafi'i said: And there is no rejection of the oath in this; for the oath of the two claimants is based on what the heirs claimed of betrayal; and the oath of the heirs of the deceased is based on what the two claimants claimed of what was found in their hands and they acknowledged that it is the property of the deceased; and that it has become theirs from him; so their claim was not accepted without evidence; and the heirs were sworn; he said: And if this is as I described, then the verse is neither abrogating nor abrogated; for Allah's command to witness two just men; and whom we are pleased with from the witnesses; this is what necessitated its relation to what preceded it; and it has been drawn to the entirety of this Surah by disputes; some of which is what has preceded in mentioning the killing; which is one of the types of death; in the story of the two sons of Adam; and what follows it; then the follow-up of that with jihad; which is one of the causes of death; and His saying (the Exalted): ﴿And We prescribed for them in it that a soul is for a soul﴾ [Al-Ma'idah: 45]; then He also mentioned it in His saying (the Exalted): ﴿They strive in the cause of Allah and do not fear the blame of the blamer﴾ [Al-Ma'idah: 54]; and the divine tradition has been established by mentioning the will after such in 'Al-Baqarah'; and it was not mentioned after one of the mentioned verses; for its increase over the verse of 'Al-Baqarah'; by disputes; among them is the oath; so it was appropriate for it to be after the verse of oaths; and among them is the severity of the oath; and the departure from what resembles it of the oath on wealth by being in a specific time; after a specific worship; so it was appropriate to mention it after the severity of the matter of hunting in a specific condition; which is the state of ihram; and the departure from its forms from the states; and after the severity of its penalty; and the departure from its forms from the expiations; and the severity of the matter of the specific place; which is the Kaaba; and the departure from its forms from the houses; and likewise the severity of the specific time; which is the sacred month; and the departure from its forms from the times; and all of that is for the establishment of the affairs of the people; and the rectification of their conditions; and thus the verse of the will; and what has come out of its rulings from its forms; all of it is for the establishment of matters upon correctness; and the rectification of livelihood; and the Hereafter; and it is turning to the beginning of the Surah; as it is one of the greatest covenants; and fulfilling it is one of the most difficult fulfillments; and to His saying (the Exalted): ﴿And cooperate in righteousness and piety﴾ [Al-Ma'idah: 2]; and to His saying (the Exalted): ﴿Be steadfast for Allah, witnesses in justice﴾ [Al-Ma'idah: 8]; look to its conclusion with His saying: ﴿Indeed, Allah is All-Aware of what you do﴾ [Al-Ma'idah: 8]; and to the fact that this is in the context of informing that Allah is All-Knowing of the hidden matters; and His saying: - in reference to what you are commanded: "So adhere to what I have commanded you; and guided you to; you will succeed" -: ﴿And fear Allah﴾; meaning: the Majestic and the Glorious; until its end; turning to His saying: ﴿And His covenant which He made with you﴾ [Al-Ma'idah: 7]; the verse; meaning: fear Allah with a great fear; that carries you to make between you and His wrath a protection; so that you do not swear falsely; or betray the slightest betrayal; ﴿And listen﴾; meaning: the admonition; with a hearing of response and acceptance; remembering your saying; ﴿We have heard and we obeyed﴾ [Al-Ma'idah: 7]; for indeed Allah guides those who hold fast to the covenant; ﴿And Allah﴾; meaning: the One who has all perfection; and the fullness of wisdom; and the completeness of might and power; ﴿Does not guide the people﴾; meaning: does not create guidance in the hearts of those who have the ability to (p-336) what they attempt; ﴿The disobedient﴾; meaning: those who are outside; meaning: from their habit that; firmly; they are never bound by a bond; nor are they confined within a circle of contract; nor a covenant.
