Commentary
And when he began by glorifying the fathers and respecting them in that the sons may marry their wives in general, he followed with the specific mention of the mother by saying: ﴿Prohibited to you are﴾. And since the greatest purpose of women is marriage, the addition of the prohibition to their very selves - to emphasize the prohibition - does not detract from its understanding. Moreover, it has already been established that what is meant is marriage; he attributed the prohibition to the essence to affirm the prohibition. He said: ﴿Your mothers﴾; meaning: the enjoyment of them, by marriage or by right hand possession. Thus, the prohibition of it was mentioned twice, to emphasize it and to strengthen its matter in itself, and out of respect for the father and to glorify his status. ﴿And your daughters﴾; meaning: even if they are lower, due to the harm that would befall their mothers. And these two categories have not been made lawful in any religion. ﴿And your sisters﴾; meaning: full sisters or not. ﴿And your paternal aunts﴾; likewise. ﴿And your maternal aunts﴾; also. The criterion for both is that every male whose lineage returns to you, his sister is your aunt. And she may be from the mother's side; she is the sister of your mother's father. And every female whose lineage returns to you by birth, her sister is your maternal aunt. And the maternal aunt may be from the father's side; she is the sister of your father's mother. ﴿And the daughters of the brother﴾; whether he is full or not. ﴿And the daughters of the sister﴾; meaning: likewise; and their branches, even if they are lower.
And when the matter of lineage concluded, which consists of seven categories, he followed it with the matter of the cause, which consists of eight. The first of them is the wives of the fathers; he specified them and advanced them to glorify their prohibition, since they have been taken lightly. And the last of them is the chaste women. He began from this section with the mother through nursing, just as he began the lineage with the mother. He said: ﴿And your mothers who nursed you﴾; to place it in the status of lineage. And for this reason, he called her a mother. Thus, every female to whom you are related by milk is your mother; she is the one who nursed you, or the one who nursed a woman who nursed you, or a man who nursed you with his milk from his wife or the mother of his child. And every woman who gave birth to a woman who nursed you, or a man who nursed you, she is your mother through nursing. And the one who nursed is your sister. And the husband of the nurse who nursed you with his milk is your father; and his parents are your grandfathers; and his sister is your aunt. And every child born to him from the nurse before and after nursing are the brothers of the father. And the mother of the nurse is your grandmother; and her sister is your maternal aunt. And every child born to her from this husband are siblings to a father and mother; and whoever is born to her from another is his siblings and sisters to a mother. Thus, his saying: ﴿And your sisters through nursing﴾ is as in lineage, on the condition that there be five sucklings and within two years, and by naming the nurse a mother, and the sharing in nursing a sister, it is known that nursing is like lineage, as the Prophet, blessings and peace be upon him, clarified by saying: "What is prohibited through nursing is like what is prohibited through lineage." Thus, the two forms are reminders of the remaining seven; the mother is a reminder of the daughter, by virtue of all birth; and the sisters are reminders of the paternal aunts, maternal aunts, daughters of the brother, and daughters of the sister, by virtue of all sisterhood.
And when what is like the flesh of kinship came to an end, he followed it with the matter of what is through marriage; so he said: ﴿And the mothers of your women﴾; meaning: you have entered into them; or not; - for what is in that often corrupts the ties of kinship; ﴿and your stepdaughters﴾; and he mentioned the reason for the prohibition and said: ﴿those who are in your guardianship﴾; meaning: by action; or by force - for what is in them of the likeness of children - ﴿of your women﴾; and when the addition is permissible in the language with the slightest connection; he clarified - glorified and exalted is He - that there must be intercourse; which he referred to by saying 'entering'; because it enables the ruling of the spouses; by which their children become like his children; so he said: ﴿those whom you have entered into﴾; he restricted it by 'entering'; because the jealousy of a mother for her daughter is less than the jealousy of a daughter for her mother.
And when this restriction indicated the permissibility of the daughter of whom he has contracted marriage; and he has not entered into her; he made it clear; as a reminder of the great prohibition of suckling; so he said: ﴿But if you have not entered into them﴾; meaning: the mothers; ﴿then there is no sin upon you﴾; meaning: in marrying them; and when he opened the prohibited ones for eternity with the wife of the father; he concluded it with the wife of the son; so he said: ﴿and the wives of your sons﴾; meaning: whether she was a wife or one who was taken by right hand possession; and when the adopted one was not intended; he restricted it by saying: ﴿those from your loins﴾; meaning: even if they are lower in rank; and what is through suckling entered; because it is like the flesh of kinship; so the restriction did not exclude it.
And when the permanent prohibition came to an end; he followed it with the temporary; so he said: ﴿And that﴾; meaning: and He has prohibited upon you that you ﴿combine﴾; by a marriage contract; because his intent is intercourse; or by intercourse in right hand possession; ﴿between the two sisters﴾; so if one of them is married; and the other is owned; the married one is permissible and the owned one is prohibited; as long as the permissible exists; because marriage is stronger; so if the permissible is removed, the other becomes permissible; even during the waiting period of the one who was permissible.
And when the combining of the two sisters was an ancient law, he said: ﴿Except for what has passed﴾; meaning: for there is no sin upon you in it; as a mercy from Allah for you; then he explained the lifting of its hardship; so he said: ﴿Indeed, Allah﴾; meaning: the One who encompasses the attributes of perfection; ﴿is Forgiving﴾; meaning: concealing what He wills of the realities of error; and its effects; ﴿and Merciful﴾; meaning: dealing with the utmost honor that is pleasing to the Divine.
