Commentary

And when the situation during the period of [the practice of] ilā' is similar to that of divorce and not the same, he stated clarifying that divorce does not occur merely by the passage of four months. Rather, either he should return or divorce. If he refuses, the judge should divorce him: ﴿And if they intend divorce﴾, so he established the intention without a preposition, meaning that they have left what they were in of hesitation and made divorce a firm decision, occurring without hesitation or concealment. And the intention is the consensus on the execution of the action. Divorce is, in meaning, like the release of something from the hand that can be taken after its release - as stated by al-Harali.

And when the one who divorces may regret it, love may lead him to deny the divorce, he frightens him with the saying: ﴿Indeed, Allah﴾, meaning the King who has glory and honor, ﴿is All-Hearing﴾, meaning of their words about Him.

Al-Harali said: In his indication, there is a notification that divorce must have an apparent utterance that is heard - it has ended.

﴿All-Knowing﴾, meaning of it and of their intention in it.

Al-Harali said: And in it is a warning about what occurs in the souls and the innermost of harm and conflict between spouses in matters that are not taken by rulings and cannot be known by the judges. So He made them guardians over themselves in what is hidden and apparent. For this reason, the scholars have seen that divorce is a trust in the hands of men, just as [the waiting period] and [the waiting for purity] are a trust in the hands of women. Therefore, the verse of the waiting period of the woman is connected to the verse of the waiting of the husband in his ilā' - it has ended.

And there remains from the rulings of ilā' a third category, which he left unexpressed, indicating that they should be in the utmost integrity regarding it, which is the insistence on causing harm. And he indicated by the attributes of forgiveness and mercy for the doer against it that the one who commits it should be treated with the opposite of them, which is a ruling known in jurisprudence, and Allah is the Grantor of success.
