Commentary
And when the warning against alteration is only in the action of justice, and the testator may sometimes be unjust in his bequest due to ignorance or a motive, this is the reason for his saying: ﴿So whoever fears﴾ meaning he knows, anticipates, and thinks. He has expressed it in this way because it is one of its causes. And perhaps he expressed this as a hint that he is satisfied with mere suspicion in it. ﴿From a testator who is unjust﴾ meaning inclined in the bequest, mistakenly. ﴿Or sinning﴾ meaning intentionally inclined in it.
Al-Harali said: And the true meaning of injustice is concealing oppression in the form of righteousness - this has ended. (p-38) ﴿So he reconciled between them﴾ meaning between the testator and the beneficiaries if that was before his death by advising him with what the thoughts have made pleasant, or between the beneficiaries and the heirs after his death if there is fear of the occurrence of evil, so he reconciled between them on a matter they are pleased with.
Al-Harali said: And in his mentioning the fear from the testator, it implies that this is during the life of the testator, not after the decision of the bequest on injustice after death, for that does not occur to him. The content of this discourse, and in the act of reconciliation on the term 'between,' implies that reconciliation is aimed at the connection between them, and it would be from the meaning of what the grammarians say, 'the action is on the wide scale' where it is not 'So he reconciled between him and them' - this has ended.
﴿So there is no sin upon him﴾ meaning by this alteration. And when the mujtahid may err, if he were to be held accountable for his error, he would refrain from striving. May Allah, glorified and exalted is He, reward him for clarifying the lifting of sin by His saying, informing of the general ruling for every mujtahid: ﴿Indeed, Allah﴾ meaning the One who encompasses all knowledge. (p-39) ﴿Is Forgiving﴾ meaning for whoever intends good and errs. ﴿And Merciful﴾ meaning He does with him the act of the merciful towards the one who is shown mercy.
