Commentary
Except by that which is best. Except for the trait that is best in dealing with the wealth of the orphan, which is to preserve it and invest it. The meaning is: preserve it for him until he reaches maturity, then give it to him with fairness. With equity and justice, we do not burden a soul except to its capacity. Except for what it can bear and does not fail to do. And the command to fulfill the measure and the balance follows this, because observing the limit of fairness, which has no increase or decrease, is what leads to hardship. So, He commanded to reach the capacity, and what is beyond it is excused, even if it is a relative. Even if the one being spoken of or against in testimony or otherwise is from the relatives of the killer, it should not increase in the saying or decrease, as in His saying: 'Even if it be against yourselves or your parents or your relatives.'
