Commentary
They wage war against Allah and His Messenger. They wage war against the Messenger of Allah, blessings and peace be upon him. Waging war against the Muslims is considered as waging war against him. They strive in the land causing corruption, or because their striving in the land is on the path of corruption, it is regarded as: and they cause corruption in the land, thus it stands as corruption. This is in meaning, and it may be an object for it, meaning for the corruption. It was revealed concerning the people of Hilal ibn Owaimir, who had a covenant with the Messenger of Allah, blessings and peace be upon him, and a group passed by them wanting only the Messenger of Allah, and they cut them off. It was said about the 'Araniyyin. Then it was revealed to him that whoever combines killing and taking wealth will be killed and crucified, and whoever only kills will be killed. Whoever only takes wealth will have his hand cut off for taking wealth, and his leg for frightening the way. Whoever only frightens will be exiled from the land. It was said that this is the ruling for every highway robber, whether he is a disbeliever or a Muslim. Its meaning is that they should be killed without crucifixion if they only kill, or they should be crucified with killing if they combine killing and taking. Abu Hanifa and Muhammad, may Allah have mercy on them, said he should be crucified alive, and stabbed until he dies, or their hands and feet should be cut off from opposite sides if they took wealth, or they should be exiled from the land if they did not exceed frightening. And from a group among them, including Al-Hasan and Al-Nakha'i, it is said that the Imam has the choice among these punishments for every highway robber without detail. Exile is imprisonment according to Abu Hanifa, and according to Al-Shafi'i, it is exile from one land to another, and he will continue to be pursued while he is fleeing in fear. It was said he is exiled from his land, and they used to exile them to 'Dahlak', which is a land in the farthest part of Tihamah, and 'Nasih', which is a land from the lands of Abyssinia, a disgrace, humiliation, and shame except for those who repent, an exception from the punished specifically for the crime of highway robbery. As for the ruling on killing, wounding, and taking wealth, it is up to the guardians; if they wish, they may forgive, and if they wish, they may demand retribution. And from Ali, may Allah be pleased with him, it is reported that Al-Harith ibn Badr came to him repentant after he had been a highway robber, and he accepted his repentance and averted the punishment from him.
