Commentary
And let not some of you consume the wealth of others unjustly in the manner that Allah has not permitted or legislated. And do not give it [the wealth] to the judges so that you may consume a portion of the people's wealth through injustice, by bearing false witness, or by false oaths, or by reconciliation, while knowing that the one who is favored in judgment is an oppressor.
And it has been reported from the Prophet, blessings and peace be upon him, that he said to the two disputants: "I am only a human being, and you bring your disputes to me. Perhaps one of you is more eloquent in his argument than the other, so I may rule in his favor based on what I hear from him. Whoever I rule in favor of something that belongs to his brother, let him not take anything from it, for what I rule for him is a piece of fire." They both cried and each one said: "My right is for my companion." He said: "Go and seek reconciliation, then let each one of you release his companion."
It has been narrated by Abu Dawood, Al-Daraqutni, Al-Hakim, Ahmad, Ishaq, Ibn Abi Shaybah, and Abu Ya'la, all from the narration of Usamah ibn Zaid from Abdullah ibn Rafi' Mawla Umm Salamah from Umm Salamah. Its origin is in the two Sahihs without the addition. And it is said (and do not give it) and you give some of it to the unjust judges in the manner of bribery. And 'to give' is a jussive verb included in the prohibition, or it is in the accusative with the implicit meaning of 'that', as in His saying: (and you conceal the truth). And you know that you are upon falsehood, and committing a sin while knowing its ugliness is more abhorrent, and its perpetrator is more deserving of reproach.
